Spanish Constitution. Article 39.
The duty of the Spanish public authorities to protect minors and safeguard their welfare is enshrined in Article 39 of the Constitution. On this article, it’s specified: 1) the obligation of the public authorities to ensure the “social, economic and legal protection of the family”, 2) the integral protection of children in a situation of equality regardless of their filiation and the marital status of the mother; 3) the duty of assistance of parents to their children, and 4) the development of legal instruments and measures to give effect to international agreements that ensure the rights of the child.
